Frequently asked questions

Short answers to the questions landowners ask us most often. For anything specific to your land, call 0800 088 6248 or send us the details.

Selling land to us

How fast can I sell my land?

It depends on the land and the deal. A straightforward outright sale of registered land with no tenants can move as fast as the two solicitors can complete the legal work. Unregistered titles, tenancies, access questions and planning conditions all add time. We won't promise a completion date until we've seen the title.

Do you charge any fees?

No. We're the buyer, not an agent, so there's no commission. You normally pay your own solicitor's fees unless we agree otherwise in writing.

What kinds of land do you buy?

Fields and paddocks near towns and villages, building plots, garden land, brownfield and small commercial sites, garage courts, barns and rural buildings, larger strategic sites, and land with awkward problems such as poor access.

Do you buy land without planning permission?

Yes. You can sell outright at a price that reflects the planning risk, or on a subject-to-planning or option basis that pays more if permission is granted.

Where do you buy land?

Across England and Wales. Planning rules differ between the two, and we take that into account in every appraisal.

How do you work out what my land is worth?

For land with development potential we estimate what the finished homes would sell for and deduct the costs of planning, building, finance, obligations and a profit margin. What's left is the land value. For land without a planning prospect, value is based on its current use.

Should I get my own valuation?

Yes, we encourage it. An independent RICS surveyor or land agent can tell you whether our offer is fair. You're under no obligation to accept it.

Who will I be dealing with?

Land is bought by S&K Property Investments and Improvement Ltd, part of the S&K Group, based in Great Barr, Birmingham.

What happens to my information?

We use it to assess your land and contact you about it. Our privacy notice explains how it's stored and your rights.

Can I sell just part of my land?

Yes. Selling one field, the end of a garden or part of a yard is common. Your solicitor will make sure the land you keep has the access and services it needs.

Development land

How do I know if my land is development land?

Ask three questions: does it sit next to existing homes, can a car get onto it safely from a public road, and is it outside the worst flood risk? If the answer to all three is yes, it is worth an appraisal. We will tell you honestly if we don't think homes are achievable.

Do you buy development land without planning permission?

Yes. Without permission we usually buy on a subject-to-planning contract or an option, so the price reflects value with permission rather than farmland value. If you need a quick, unconditional sale, we can also make an outright offer that reflects the planning risk.

What size of site do you buy?

We look at sites from around a quarter of an acre for a single plot up to large fields on the edge of towns. Size matters less than location, access and planning prospects.

Will I pay any fees to you?

No. We are the buyer, not an agent, so there is no commission. You will normally pay your own solicitor unless we agree otherwise in writing.

Land without planning permission

Can I sell land without planning permission?

Yes. Land without consent is bought and sold every day. The question is whether you want a lower price now or a higher price later that depends on permission being granted.

What is hope value?

Hope value is the premium a buyer pays above the current use value because there is a realistic prospect of planning permission. It is higher the more likely and closer that permission is.

Who pays for the planning application?

On subject-to-planning and option deals we normally fund the planning work. On an outright purchase it is our risk and our cost after completion.

What happens if planning is refused?

On a conditional contract or option, if permission is not granted within the agreed period the deal ends and you keep the land. Any option fee paid is usually yours to keep.

Garden land and backland

Can I sell part of my garden?

Yes. Your solicitor will divide the title, and your mortgage lender will need to agree to release the land if it has a charge over it.

Will selling part of my garden reduce my home's value?

It can, especially if the garden becomes small or overlooked. We'll talk this through so you can weigh it against the plot price.

Do I need planning permission to sell garden land?

Not to sell it, but planning permission is what gives the land its value, so we usually buy subject to planning.

What if my neighbour wants to sell too?

Combined sites often work better. We can make offers to both and structure the deal so each owner is treated fairly.

Option agreements

What is an option agreement?

A contract that gives the buyer the right to buy your land within a set period, usually after planning permission is granted. You receive an option fee now and the purchase price if the option is exercised.

Do I keep the option fee if you don't buy?

Normally, yes. The terms are set out in the agreement.

How is the price set?

Usually as a percentage of the land's market value once permission is granted, minus agreed costs, with a minimum price. The percentage and deductions are negotiated.

How long do options last?

It varies with the site. Several years is typical for land needing local plan allocation, often with extension rights.

Subject-to-planning sale

What is a subject-to-planning sale?

A sale where contracts are exchanged now, but completion depends on planning permission being granted. If it isn't granted by the long-stop date, the contract can end.

Who pays for the planning application?

We do, along with the surveys and consultants needed to support it.

What happens if planning is refused?

We may appeal if the contract allows. If permission isn't secured by the long-stop date, the contract ends and you keep your land.

Can I still use the land before completion?

Usually yes, until we need access for surveys or until completion.

Inherited and probate land

Can executors sell land before probate is granted?

They can agree a sale and start the legal work, but most solicitors won't exchange contracts until the grant is issued, and completion needs it.

Do all beneficiaries have to agree?

Executors make the decision, but they must act in the beneficiaries' interests. Many involve beneficiaries to avoid disputes. Take legal advice if there's disagreement.

Is there tax to pay when inherited land is sold?

Inheritance tax may apply to the estate, and capital gains tax may apply to any rise in value after death. Speak to the estate's accountant or solicitor.

What if the land is unregistered?

It can still be sold. The title will be registered as part of the sale, which adds some time.
